Judgement

HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Anambra State delivered by Hon. Justice P. C. Obiorah on 15/4/2013. The Respondents as plaintiffs at the High Court via a summary judgment proceeding under Order 11 of the High Court of Anambra State (Civil Procedure) Rules, 2006 filed writ against the Appellant and claimed the following reliefs:

a. An Order of the Court compelling the defendant to pay over to the plaintiffs the sum of N180,000.00 (One Hundred and Eighty Thousand Naira) being the rent for one shop (AK15) he occupies at 1, Kano Street, Onitsha, for the period of one year, that is from 1st February, 2012 to 31st January, 2013.

b. An Order of Court compelling the defendant to pay over to the plaintiffs the sum of N150.000.00 (One Hundred and Fifty Thousand Naira) being the rent for one shop (AK119) he occupies at 1, Kano Street, Onitsha, for the period of one year that is from 1st of September, …
