TOM SHAIBU YAKUBU, J.C.A. (Delivering the Leading Judgment): The appellant, former Provost Interim of Nwafor Orizu College of Education Nsugbe, Anambra State, along with one other person Mr. Michael Emeka Ekwunife, the Bursar of the same Institution, were arraigned by the 1st respondent, for prosecution at the Federal High Court, sitting at Awka, Anambra State, for the offences of conspiracy to obtain money by false pretence and obtaining money by false pretence, contrary to Sections 8(a) and 1(1) of the Advance Fee Fraud and Other Related Offences Act, 2006. The information filed by the 1st respondent against the defendants contains eight (8) counts, detailing the various amounts of money allegedly withdrawn by the 2nd Respondent for the appellant from the Access Bank account of the Nwafor Orizu College of Education, Nsugbe, Anambra State, to settle the hotel bills of the appellant as the Provost Interim of the aforesaid Nwafor Orizu College of Education, Nsugbe, Anambra State betwee…
