HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Ogun State High Court of Justice holden at Ijebu-Ode, delivered by S.A. Olugbemi, J on the 20th day of July, 2012 in Suit No: HCJ/190/2007.
By a Writ of Summons and Statement of Claim filed on the 17th day of December, 2007, the Appellants who were Claimants sought the following reliefs against the Defendants/Respondents:
1. A DECLARATION that the nomination of the 2nd Defendant by the 1st Defendant is contrary to the 1st Defendants duties as the Prescribed Authority under Section 22(3) of the Chiefs Law of Ogun State and the nomination is therefore null and void and of no effect.
2. A DECLARATION that pursuant to Section 22(3) of the Chiefs Law of Ogun State, the duty of the 1st Defendant was confined to determining the questions of Customary Law which were in dispute that were brought before him by the Plaintiffs and the Igbaga Community on the one hand and the 2nd Defendant, 3rd…
