PHILOMENA MBUA EKPE, JCA (Delivering the Leading Judgment): This appeal is against the judgment of the Delta State High Court holden at Asaba and delivered on the 13th day of January, 2009 in which the appellant petitioned for a dissolution of the marriage. The petition was however dismissed in favour of the Respondent hence this appeal.
The brief facts of the case are as follows:
The Appellant Mr. Richard Orere as Petitioner in the lower Court initiated this suit by way of a NOTICE OF PETITION against the Respondent Mrs. Juliet Orere. The parties got married on the 10th day of September, 2005 at VOICE OF GOD BIBLE CHURCH, DECCO Road, Warri, Delta State. The Certificate of Marriage was tendered as Exhibit A at the lower Court.
