Judgement

OLUKAYODE ARIWOOLA, J.C.A. (Delivering the Lead Judgment): This is an appeal by the Progressive Peoples Alliance (PPA) who was sued as 3rd Respondent at the Election Tribunal against the decision of the National Assembly, Governorship and Legislative Houses Election Tribunal which sat at Umuahia, Abia State, contained in the Judgment of the Tribunal delivered on the 25th February, 2008.

This appeal emanated from two different election petitions to wit:

(a) No. ABS/GOV/EPT/4/07 filed by Onyema Ugochukwu and Anor. Against Chief T.A. Orji and 2894 Ors, including the present Appellant who was used as 3rd Respondent.

(b) No. ABS/GOV/EPT/9/07 filed by the Peoples Democratic Party against Chief T.A. Orji and 2894 others including the present Appellant who was sued as 3rd Respondent.

From the records, it is clear that the Appellant and 1st Respondent were two of the several registered Political Parties in Nigeria which contested through their respective candidates, the Gubernatorial election …
