Judgement

DARAMOLA J (Delivering the Judgment): The defendant was arraigned, on information filed, for the offence of the murder of Pa Benson Egunlae contrary to section 316 of Criminal Code Law of Ondo State, 1978 as applicable in Ekiti State. The deceased who was also the father of the defendant among other children was savagely attacked and hacked under circumstances of extreme monstrosity.

The State’s case against the defendant revolved round the testimonies of two (2) witnesses - PW1 and PW2.

Pastor Rufus Oluwasola Benson (PW1) testified that there was complaint that the defendant shifted the boundary of a portion of land between him and PW2 on Pa Benson Egunlae’s farmland earlier partitioned by him among his children and wife due to incessant bickering he had to endure from the defendant over his said property.
