(Delivering the Leading Judgment): This Appeal is against the Judgment of the Federal High Court of Nigeria, Maiduguri Judicial Division in Suit No. FHC/MG/CS/10/2015 delivered on 14/11/2016 by Hon. Justice M. T. Salihu. The facts leading to the Appeal are concisely as follows: The 1st Respondent who was the Applicant at the lower Court was arrested and detained by the 2nd Respondent based on the publication made by the 1st and 2nd Appellants. The 1st Respondent as applicant instituted an action for the enforcement of his fundamental human rights averring that his arrest and detention by the 2nd Respondent was orchestrated by the 1st and 2nd Appellants on the publication of a petition to the then Inspector General of Police which Appellants claim was authored by the 1st Respondent.
