MISITURA OMODERE BOLAJI-YUSUFF, J.C.A. (Delivering the Leading Judgment): The appellant in this appeal was one of the aspirants who contested the primary election conducted by the 1st respondent on 29/11/2014 to elect its candidate for the House of Assembly Election for Ezeagu State Constituency of Enugu State in the general election held in 2015. Hon. Cecilia Ezeilo won the said primary election. Shortly after winning the said primary election, Hon. Cecilia Ezeilo was selected as the running mate of Hon. Ifeanyi Ugwuanyi, 1st respondent's governorship candidate in Enugu State in the 2015 general election. Consequently, she withdrew her candidacy for the House of Assembly. According to the appellant, by this development he became the candidate with the highest number of votes cast at the primary election and therefore the duly elected candidate of the 1st respondent for the 11th April, 2015 election into the Ezeagu State Constituency in Enugu State House of Assembly.
