OKUNOLA, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Tsoho J. of the Federal High Court, Ilorin, Kwara State delivered on 20/8/99 wherein the court nullified the suspension order placed on the respondent by the appellant. The facts of the case briefly put were as follows:-

The claim of the applicant/respondent in the lower court was an application for judicial review of suspension order placed on him by the appellant and contending among others, that the suspension order be quashed, that the appellant be prohibited from further investigating the matter that was being heard by a Chief Magistrate's Court, Ilorin and that the respondent/appellant be restrained from further suspending him from the University or interfering with his academic pursuit in respect of the same matter and allegation pending before an Ilorin Chief Magistrate's Court.
