OGUNBIYI JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Federal High Court Lagos Division presided over by Hon. Justice M. B. Belgore as he then was. Pursuant to his judgment delivered on the 9th June, 1999 an original notice of appeal was filed on the 4th September, 1999. By the leave of this court on the 19th November, 2002 the appellants amended their grounds of appeal and filed an amended notice of appeal on the 25th November of the same year.
The respondent herein was the plaintiff at the lower court, whose claim in the suit was for a judicial review of the findings and recommendation of the University of Lagos senate panel that tried him, the plaintiff. At page 43 of the record, the following were the five reliefs sought by the applicant per his statement for the judicial review therefore:-
