ADAMU JAURO, J.C.A.(Delivering the Leading Judgment): The appeal herein is against the judgment of the Adamawa State High Court of Justice, Yola delivered on 19th November, 2012 in suit No. ADSY/10/2007 by Hon. Justice A. D. Mammadi.
The facts giving rise to this appeal can be summarized as follows: The plaintiff now appellant, commenced the action resulting in this appeal by a writ of summons dated 7th March, 2007. The action was initially against the 1st and 2nd respondents as defendants. Subsequently, with the leave of Court, the 3rd, 4th and 5th respondents were brought in as defendants.
The appellant as plaintiff by his second further amended statement of claim dated 23rd May, 2009 claimed the following reliefs against the defendants:
