MANGAJI, JCA (Delivering the Lead Judgement): This is a further appeal from the decision of the High Court of Bauchi State (Coram H. S. Mohammed and Said Mohammed J.J.) siting in its appellate jurisdiction in suit No. BA/82A/95 wherein the judgement of the Upper Area Court II, Bauchi was reversed. Not satisfied with the decision, the appellants herein, who were the plaintiffs as at the trial court, appealed to this court. According to learned counsel for the appellants and as contained in the reply brief, the appellants promptly applied, by way of motion on notice, for leave to appeal against the said judgement. The oral argument on the motion was taken on 12/3/96 and on 21/3/96 leave was granted by the court below. That the appeal was in the event filed on 28/3/96, albeit the notice and grounds of appeal does not indicate the date of filing. In all, the appellants filed three grounds of appeal.
