Judgement

JUDGMENT 

1st plaintiff is the head of the Obale Akua family of Honi Obale Akua,  Amasaman, while 2nd plaintiff is a principal member of the said family. The  plaintiffs brought this action on behalf of the Obale Akua family against  defendants for declaration of title to the land in dispute, a declaration that 1st defendant is not a member of plaintiff’s family, an order vitiating and  cancelling any grant made by 1st defendant to 2nd and 3rd defendants,  perpetual injunction restraining defendants and their agents from interfering  with the land in dispute, recovery of possession and general damages. 

In their statement of claim, plaintiffs asserted that their great grandmother,  Obale Akua, acquired the land in dispute in 1904 by purchase. After acquiring  the land, she cultivated a farm and established a village on it. Plaintiff’s  claimed that although 1st defendant was not a member of their family, he had  taken control of their land and was alienating portions to third parties …
