(DELIVERED BY JAMES SHEHU ABIRIYI, J.C.A.) This is an appeal against the judgment delivered on 12th May, 2014 in the High Court (Court below) holden at Yola in its appellate jurisdiction. The Appellant instituted an action against the Respondent in the Area Court Mayo Belwa in Adamawa State claiming title to the land in dispute. The trial Area Court entered judgment in favour of the Appellant. The Respondent appealed to the Upper Area Court No. 3, sitting in Yola, Adamawa State. His appeal was dismissed. The Respondent then proceeded to the High Court. The High Court allowed his appeal. It set aside the judgments of the Upper Area Court and the trial Area Court and declared the Respondent the person entitled to the land in dispute. It was now the turn of the Appellant to appeal and he appealed to this Court by a notice of appeal dated and filed 24th October, 2014 leave and extension of time having been sought and granted by this Court on 20th October, 2014.
