AFRICAN CONTINENTAL BANK PLC V. STEVE EVOLOCHA

MUHAMMAD, JCA (Delivering the Lead Ruling): By a notice of motion dated 14th December, 1999 and filed on 30th December, 1999, the applicant to whose application this ruling relates prayed for the following orders:-

(1) Extension/enlargement of time within which to apply for leave to appeal.

(2) Extension of time within which to appeal.

(3) Leave to appeal and

(4) Any other order or orders as the Honourable Court may deem just to make.

The application is supported by a twelve-paragraph affidavit and five annextures: Exhibits A, B, C, D, and E. The accompanying affidavit was sworn to by the applicant himself.

The judgement in respect of which the application was made, Exhibit ‘C’, was delivered on 23rd February 1981 by Hon. Justice Anthony I. Iguh, as he then was.
