Judgement

MONICA BOLNAAN DONGBAN-MENSEM, J.C.A.(Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Ogun State presided over by Honourable Justice N.I. Saula delivered on the 3rd day of August, 2012 in which the award of the sum of Ten Million naira (N10m) only was made against the Appellant and in favour of the Respondent. The Appellant is aggrieved and has appealed to this court seeking a reversal of the decision.

The brief facts of the case leading to this appeal is that on the 22nd February, 2006 the Appellant forwarded a petition to the Economic and Financial Crimes Commission (EFCC) against the Respondent on the alleged Respondent's fraudulent attempt at the encashment of a Western Union Remittance in the sum of Eight Hundred US Dollars at the Appellant's Ijebu-Ode Branch.

Following the petition, the Respondent was arrested by the Economic and Financial Crimes Commission (EFCC), prosecuted but was later discharged and acquitted by the Court.
