Judgement

OBADINA JCA (Delivering the Lead Judgment): This is an appeal against the decision of the High Court of Plateau State contained in the judgment of SIRAJO J. dated the 17th day of February, 2003. The appellant, a registered political party was the plaintiff at the trial court, while the respondents were the defendants. The plaintiff/appellant commenced the action by originating summons. In the originating summons dated the 19th of September, 2002 and filed on the same date, the plaintiff/appellant asked for the determination of the following questions, namely:- “(1) Whether the 1st defendant, Plateau State Independent Electoral Commission is bound to observethe conditions for qualification and disqualification of candidates for Local Government election stipulated under sections 106 and 107 of the 1999 Constitution by virtue of section 7(4) of the 1999 Constitution.
