V. A. O. OMAGE, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Local Government Election Tribunal Sokoto State. The judgment was delivered on 20th day of January, 1999 and the petition of the appellant was dismissed.
The appellant being dissatisfied has filed this appeal against the judgment. The appellant has submitted two issues for determination these are:-
(a) Whether or not the contents of Exhibit A constitute an indictment. (Exhibit A is a copy of the report of inquiry into Hajj operations). These are:-
(b) Whether or not the petitioner appellant proved his case in totality of the evidence.
The appeal was filed in the lower tribunal on 25/1/99, and by provision of the law the appeal should be disposed off within 30 days. On 14th February when the brief of argument of appellant was brought before this court no evidence of proof of service of the appeal on the respondent was shown.
