NONYEREM OKORONKWO, J.C.A. (Delivering the Leading Judgment): This appeal arose from the Judgment of the Ogun State High Court delivered by Hon Justice O. Mabekoje on 7th March 2011 whereby in the case where damages for libel and injunction were claimed, judgment was entered in favour of the claimant with an order of perpetual injunction to restrain the defendant from a continuation of the same tort.
It is against the Judgment that the defendant as appellant commenced this appeal against the claimant as respondent by a Notice of Appeal dated 30th March 2011 and filed 1st April 2011.
The claims of the appellant at the Court below were as follows:-
(1) The sum of N50,000,000.00 (Fifty Million Naira) as damages for the libel authorized, printed and published by the defendant in his letter dated 19th of January, 2005 concerning the plaintiff under the title Transformer Installation to Oke-Odo, Igan, Ago-Iwoye, Chairman Kalejaiyes Uncomplimentary Attitude.
