NGWUTA, J.S.C. (Delivering the Leading Judgment): Endorsed on the writ of summons in suit No. HCA/74/2011 filed in the Agbara Division of the High Court of Justice of Osun State on the 20th day of December, 2011 are the plaintiffs’ claims against the defendants.

“1. Declaration of court that the claimants are persons entitled to the statutory right of occupancy in respect of that piece of oan(sic)parcel of land lying and situate at Ilemu/Ifako Village via Ado-Odo, Osun State bounded as follows:-

a. At the Southern part by Ifio Land.

b. At the Northern part by Ifighe Farmland.

c. At the left hand side by Idomiorin farmland.

d. At the right hand side by Odu, Ati-Kekere Idojuna farmland.

2. Forfeiture of the customary tenancy of the defendants on the ground of gross misconduct.

3. Possession of the land in dispute.

4. Order of perpetual injunction restraining the defendants, their agent and privies from trespassing on the land in dispute.
