Judgement

ADEKEYE, JCA (Delivering the Lead Judgment): This action has its cause in the wrongful termination of a contract of employment. The plaintiff L.A.A. Adeomi now appellant before this court challenged the termination of his employment in a suit filed in the High Court of Justice, Oyo State - Ibadan judicial division, on the 17th day of January 1990, whereupon he claimed as follows:-

A(1) Declaration that the purported termination of the plaintiff from the services of the defendant, by letter Ref No. PL/838/1/72 of 12/6/87 is illegal contrary to the procedure laid down in the conditions regulating the employment of the applicant and/or contrary to the rules of Natural Justice, null and of no effect.

Declaration that having not complied with pre-conditions laid down by Decree No.17 of 1984 the defendants have not acted pursuant to the Decree and therefore not protected by the Decree.

An order reinstating the applicant as Principal Technical Officer in the service of the defendants.
