MR. EMMANUEL O. ADERIBIGBE & ORS V. VINTAGE PRESS LIMITED & ANOR

UZO IFEYINWA NDUKWE-ANYANWU, J.C.A.(Delivering the Leading Judgment): This is an appeal against judgment of the High Court of Ondo State delivered on 27th June, 2013 by Hon. Justice S. A. Bola.

By a writ of summon together with a Statement of claim dated 15th October, 2010, the claimants now Appellants claimed as follows:

A. A Declaration that the article titled "The evil they are doing to me because of my childlessness written by the 2nd Defendant and published by the 1st Defendant on page 55 of "The Nation" on 11th July, 2010 is libelous and defamatory of the character of the Plaintiff.

B. An order of the Honourable Court mandating Defendant to tender unreserved apology in their Newspaper and in at least 2 other daily Newspapers with International coverage.

C. Payment by the Defendants to the Plaintiffs of the sum of ₦200,000,000.00 (Two Hundred Million Naira only) as General Damages for the Defendants' libelous publication.
