Judgement

ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): The Appellants lodged this appeal against the decision of the High Court of Justice, Ogun State sitting at Ijebu-Ode Judicial Division Coram S.E. Akinbiyi, J., delivered on December 16th, 2016, in which the claims of the Appellants were dismissed.

The parties are all from Ijebu-Isiwo in Ijebu-Ode, Ogun State. The Appellants brought action against the Respondents seeking the following orders:

1. A DECLARATION that the 1957 declaration made under Section 4 (2) of the Chiefs Law regulating the selection of headship of Ijebu-Isiwo is in consonance with the established Custom and tradition.

2. AN ORDER compelling the 1st defendant to call upon the RULUJA RULING HOUSE to present a candidate for the vacant position of OLOJA OF ISIWO being next ruling house in –turn.

3. A perpetual injunction restraining the 1st defendant from personally and unilaterally nominating and installing the 2nd defendant as OLOJA OF ISIWO.
