Judgement

NDUKWE-ANYANWU JCA:(Delivering the Lead Judgment): This appellant was charged along with two other co-accused persons on an amended information with five-counts of conspiracy to commit armed robbery and armed robbery contrary to section 6(b) and section 1(2) (a) (b) of the Robbery and Firearms (Special Provisions) Act Cap. R11, Vol. 14, Laws of the Federation of Nigeria, 2004, before Honourable Justice O. O. Akeredolu of the High Court of Ondo State.

The appellant was the 1st accused person. The particulars of the offence charged read as follows: that on 14 July 2011, Adegbola Adetayo (1st accused), Uchenna Nwaiyinya (2nd accused) and MondayAkamu (3rd accused) did conspire at Shagari village, Akure to commit armed robbery. That whilst armed with agun, the 1st and 2nd accused persons robbed Azeez Akande of a Honda CRV Jeep, a handset and cash sum of N3,140. On 15 July 2011, whilst armed with a gun, the 1st and 2nd accused persons robbed Felix Sonusi of a car belonging to Morning Dew Car…
