AHMAD OLAREWAJU BELGORE, J.C.A. (Delivering the Leading Judgment): The Respondent was the plaintiff before the High Court of Enugu (Now, The Trial Court), claiming against the Appellant, who was the defendant the following:-

1. A DECLARATION that the defendant being a mere licensee of the plaintiff, the Provisional Offer of Appointment as licensee given to the defendant by the plaintiff was validly terminated by the plaintiff by its letter dated 6 August, 2009.

2. A DECLARATION that the plaintiff is in possession of and is entitled to continue to retain possession of the AP Expressway Filling Station along Enugu-Onitsha Expressway, Enugu.

3. AN ORDER OF INJUNCTION restraining the defendant, his agents, privies or whosoever acts on his behalf in any manner whatsoever from interfering with or obstructing the plaintiff in the running of the AP Expressway Filling Station along Enugu-Onitsha Expressway, Enugu.
