Judgement

ABUBAKAR DATTI YAHAYA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the trial High Court Kogi, holden at Okene, delivered on the 29th of November, 2012. The claimant, through his guardian ad litem, now appellant, filed the action before the court and in the Further Amended Statement of claim, averred that he is the son of the defendant, now respondent. He was brought up by his grandfather and put in school up to the age of eleven years without any contribution from the father (respondent). He was taken to live with the respondent but after some time, relations deteriorated to a level that he had to be taken back to his grandfather. He therefore put up claims of "expenditure per term (four months) during Secondary School." The respondent denied paternity of the claimant and the totality of the expenditure.

The matter went to trial and at the end of the day, the trial court held that the claimant is indeed the son of the respondent, born out of wed…
