<h1 style="text-align: center"><strong>JUDGMENT</strong></h1><p style="text-align: justify"><strong><u>ADJEI, J.A:</u></strong></p><p style="text-align: justify">The High Court, Accra, on 8th November 2022, gave judgment for Plaintiff on all the reliefs sought on its writ of summons and dismissed all the reliefs sought by Defendant on its counterclaim. The Defendant, being dissatisfied with the judgment of the High Court, invoked the appellate jurisdiction of this Court by filing its notice of appeal on 15th November 2022. The parties in this appeal, for ease of reference, shall maintain their respective designations used in the High Court as Plaintiff and Defendant.</p><p style="text-align: justify">The brief facts of the case are that the Plaintiff is engaged in the manufacture, production, and sale of Health and Beauty products which are distributed under its trademark, and subsequently acquired and took over JF Lab Inc, another entity that was engaged in the production, manufacture, and sale of Health and Beauty products which are distributed under its trademark in the United States of America.
