FATIMA OMORO AKINBAMI, J.C.A. (Delivering the Leading Judgment): This appeal arose from the decision/ruling of the High Court of Lagos State (hereinafter the lower/trial Court) presided over by Hon. Justice K.O. Alogba , J. (Now Chief Judge) and delivered on 5th December, 2016.

The Appellants were dissatisfied with the Ruling, and they filed a Notice of Appeal dated 6th June, 2017 against the said Ruling.

BRIEF STATEMENT OF FACTS

The 1st Respondent as claimant commenced the action before the trial Court by Writ of Summons, and other front-loaded documents on the 3rd of April, 2006. The action was originally against the Appellants as 2nd Defendant.

The 2nd Respondent was joined as 2nd Claimant, and the originating processes amended by an order of the trial Court made on the 12th November, 2013. By the same order, the 1st and 2nd Appellants were joined as 2nd and 3rd defendants.
