ADEKEYE, JCA (Delivering the Lead Judgment): The plaintiffs, now respondents, Samuel Olujimi Sogeke and Florence Olufunmilayo Dopemu

(Nee Sogeke) sued on behalf of Sogeke Family of Asero Compound, Ijemo, the defendants, now appellants, Prince Bola Adesumbo Ajibola, and His Royal Highness, Oba Oyebade Lipede in an action No. AB/172/94 filed in the High Court of Ogun State, Abeokuta Division on the 18th of October, 1994. Indorsement on the writ of summons shows the nature of the reliefs sought by the respondents against the appellants as follows:-

(1) A declaration that the sum of N5,000.00 being rent for 10 years as per lease agreement dated 11th October, 1975 and registered as No. 52 at page 52 in volume 503 at the Lands Registry, in the office at Ibadan, now at Abeokuta Ogun State, is oppressive and ought to be reviewed in accordance with the rents review clause in the said lease.
