JUMMAI HANNATU SANKEY, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Justice of Borno State in Charge No. BOCH/MG/CR/119/2019, delivered on February 24th, 2019, by Fadawu Umaru, J.

The facts of the case leading to the appeal are as follows: A complaint was lodged at the SCID Maiduguri vide a petition by one Musa Galadima Esq. of Audu Musa and Co. Chambers Maiduguri on behalf of the complainant, Bola Omojoriowo, against the Appellant. Therein, she complained that the Appellant raped her two daughters, Timi Williams and Esther Williams, between the years 2012 to 2019 on several occasions at the Cherubim and Seraphim Church and also at other locations in Maiduguri. After due investigation of the allegation, the Appellant was arrested and arraigned before the lower Court on two counts of rape contrary to Section 282 and punishable under Section 283 of the Penal Code Law, Cap 102 Laws of Borno State, 1994.
