Shuaibu J, of the Federal High Court, Lagos, in Suit No. FHC/L/CS/198/2004 delivered on 28January 2005.The saidrulingdismissed the plaintiff/appellant’s case for being statute-barred, pursuant to section 2(a)of the Public Officers (Protection) Act,Cap. 379, Laws ofthe Federation of Nigeria, 1990. A synopsis of the facts giving rise to this appeal can be briefly stated thus: The plaintiff/appellant was employed by the defendant/respondent on A 4 October 1982 as a clerical assistant on salary grade level 03, and he rose to the rank of clerical officer I, with effect from 1 January 1998. On 10 July 1991, the plaintiff was posted from the NYSC Directorate Headquarters, Abuja to N.Y.S.C Secretariat, Lagos.
