MUHAMMAD, JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Lagos State High Court, Ikeja division, in Suit No. ID/150/86, delivered on 21st day of June 1996. The respondents had as plaintiffs for themselves and on behalf of members of the Idomila family being descendants of Oba Ajibowo claimed against the appellants being defendants for:- “(1) A declaration that the plaintiffs are entitled to the statutory right of occupancy in respect of all the parcel of land known and called Imodo Aro in Iba, Badagry division of Lagos State which is particularly bounded on the North by Neidan family land, on the South by Olga family land, on the East by both theIdomila and Aganbi families land and on the West by the Lagoon.
