Judgement

OGEBE, JCA (Delivering the Lead Judgment): The appellant sued the A respondent in Aba High Court by a writ of summons dated the 27th day of October, 1988 and later filed a statement of claim dated 17th of August, 1989 seeking the following reliefs:

“(a) A declaration sued the respondent in Aba High Court by a writ of summons dated the 27th day of October, 1988 and later filed a statement of claim dated 17th of August, plaintiff’s condition of service.

(b) A declaration that the purported termination of the plaintiff’s employment by the defendant on 4th February, 1985, is irregulars and or in breach of the rules of natural justice and is therefore null and void.

(c) A declaration that the plaintiff has been a staff of the defendant at its depot of Osiosioma since 1979 and that he is still a staff of the corporation and therefore entitled to the rights, benefits and privileges (including salaries) attached to his post with the Corporation up to the date of judgment and thereafter.
