Judgement

TINUADE AKOMOLAFE-WILSON, J.C.A. (Delivering the Leading Judgment): By a Writ of summons dated 16th March, 2010, the respondent, as claimant in the High Court of Kogi State, claimed against the appellant the following

"1. A declaration that the purported sale/transfer of the land and building belonging to the late Hajiya Ebun Audu by the late Salawu Audu to the defendant is null, void and of no effect whatsoever.

2. An Order setting aside the purported sale as same was "carried out" without the knowledge and or consent of the claimant and all the other members of the family of the said Late Ebun Audu.

3. An Order directing the defendant to vacate the premises forthwith.

4. An Order of Perpetual injunction restraining the defendant either by herself, her servants, agents, workmen and or privies from further trespass upon the said land and building and or in any way interfering with the claimant's family title over the said land and building."
