Judgement

MOHAMMED BABA IDRIS, J.S.C. (Delivering the Lead Judgment): This is an appeal against the judgment of the Court of Appeal, Ilorin Judicial Division, delivered on the 21st day of February, 2020, in Appeal No. CA/IL/9/2019, Coram: Ibrahim Mohammed Musa Saulawa, JCA, Ibrahim Shata Bdliya, JCA, and Balkisu Bello Aliyu, JCA, wherein the Court below dismissed the Appellant's appeal and affirmed the judgment of the High Court of Kwara State, which had granted the reliefs sought by the 1st Respondent, who was the claimant at the trial. 

By an Amended Statement of Claim dated and filed on the 9th day of July, 2013, the 1st Respondent (then Claimant) claimed against the Appellant and the 2nd and 3rd Respondents as follows: 

  1. A declaration that the purported agreement and/or sale of the claimant's property/house at No. 2C, Ogori Road, Adewole Housing Estate, Ilorin, Kwara State, to the 1st Defendant by the 3rd Defendant is null and void, same having been transferred to the claimant on consideration…
