This appeal emanates from two (2) Rulings of the High Court, Commercial Division, Accra dated 22nd November, 2017 and 12th December, 2017 respectively.

The Plaintiffs/Respondents sought at the trial Court, to recover possession of the disputed property as Administrators and Beneficiaries of the Estate of the late Victoria Amerley Quaye, amongst other reliefs.

According to the Plaintiffs/Respondents, the late Madam Victoria Amerley Quaye died intestate on 9th June, 2000. Her last place of abode was H/No. B 207/14, Mataheko, Accra. Four of her children applied for and were granted Letters of Administration dated 9th July, 2001. The four children therein are:

“1. Alex Adotey Mingle (1st Plaintiff; resident in Chicago Illinois, USA but visiting Ghana occasionally)

2. Samuel Nii Saka Mingle (address in Illinois unknown)

3. Phillip Yovonoo (1st Defendant)

4. Sandra Yovonoo (2nd Plaintiff)”
