(DELIVERED BY JAMES SHEHU ABIRIYI, J.C.A.) This appeal is against the judgment delivered on 26th July, 2016, in the High Court of Adamawa State sitting as an appellate Court. The matter travelled from the Area Court Fali, Mubi where the Respondent claimed title to the disputed land from the Appellant to Upper Area Court, Mubi whereto the Appellant appealed and to the High Court whereto the Appellant again appealed. The cases of both parties at the Area Court were very simple and short. Each of them claimed that his grandfather first cleared the land. That the father of each party inherited the land from his grandfather and each of the parties inherited from his father. The Area Court visited the locus in quo after hearing evidence of three witnesses called by the Respondent and five witnesses called by the Appellant.
