JUDGMENT
On the 10th of June, 2014, the Plaintiff issued a writ against the Defendant for the following reliefs;
(a) The sum of GH₵60,000 being balance of sugar and rice supplied to the Defendant.
(b) Interest on the said sum at the prevailing lending bank rate from 24/10/2013 till date of final payment. (c) Costs, including lawyer’s fees.
THE CASE OF THE PLAINTIFF
The Plaintiff’s case, according to the pleadings and the evidence, is that he is a businessman resident and carrying on business in Accra and that the Defendant also carries out business in Accra. According to the Plaintiff, in 2013, at the request of the Defendant, he supplied her with rice and sugar worth GH₵80,000 which the Defendant promised to pay by October, 2013. That in furtherance of the said promise, the Defendant issued her Fidelity Bank cheque dated 24/10/13 for the said sum, which cheque was dishonoured.
