HASSAN ALIU V. THE STATE

EBIOWEI TOBI, J.C.A. (Delivering the Lead Judgment): This appeal is against the decision of the Oyo State High Court delivered on 22/12/2022; Coram: I. S. Yerima J. (now Chief Judge). The Appellant here was charged along with 5 others for the offences of conspiracy, kidnapping, deprivation of liberty, armed robbery, aiding and abetting contrary to Sections 516, 364, 365 of the Criminal Code, Sections 1, 6(a)(b) of the Robbery & Firearms (Special Provision) Act, Laws of the Federation, 2004. It was an original 6 count charge filed on 23/9/2015 found at pages 3-4 of the record but the charge was amended to a 7-count charge via an application made on 29/2/16 which was granted on 30/11/2016 (pages 48-53 of the records). The plea was taken on the Amended charged attached to the affidavit in support of the motion as Exhibit A.
