Judgement

YAHAYA JCA (Delivering the Lead Judgment: At the Niger State High Court, sitting at Minna (the trial court), the appellant was charged, convicted and sentenced to death by hanging and convicted of the offence of armed robbery, contrary to section 1(2)(a) and (b) of the Robbery and Firearms Act, on 28 June 2016. The charge reads: That you Abdullahi Aliyu of Yidna Village via Paiko in Paikoro Local Government Area of Niger State on about 31 March 2015, in company of one Shehu, (now at large) at a place between Yidna and Yandayi village, within the jurisdiction of this honourable court attacked one Jibrin Tanko who was carrying one Sani A Yusuf on his (Jibrin’s) Bajaj Motorcycle while armed with cutlasses and sticks, and robbed him of the said motorcycle and that you thereby committed an offence punishable under section 1(2)(a) and (b) of the Robbery and Firearms Act.
