MOHAMMED, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the Kaduna State High Court of Justice delivered by Inuwa, J. on 22/10/99 discharging her interim orders made on 6/9/99 granting the appellant who was the applicant extension of time to serve on the respondents an application for an order of certiorari , leave to issue and serve on the respondents the said application for an order of certiorari and directing a stay of further proceedings in the matter before the Kaduna Rent Tribunal in suit No. RT/CT.5/15/99 pending the determination of the substantive application for the order of certiorari by the High Court. The discharged orders which were granted ex-parte by the learned trial Judge were made as follows:-

“The application is granted as prayed. The order of the court shall lapse after 14 days or on the hearing and determination of the motion on notice to be filed.”

The matter was then adjourned to 17/9/99 for hearing the motion on notice. H…
