MUSDAPHER, JCA (Read the Lead Judgment): The plaintiff, Professor Albert F. Ogunsola filed an Originating Summons commencing this suit at the High Court of the Federal Capital Territory Abuja in the following terms:-
ORIGINATING SUMMONS
Let all the defendants above named, within 8 days of the service of the summons on them inclusive of the day of such service cause appearance to be entered for them to this summons which is issued upon the application of the plaintiff who resides at Ilorin within Kwara State and seek the Honourable Court’s determination of the following questions:- Whether having regard to the provisions of Articles 16.1, 18(2 ) and (6) and 20(1) of the constitution of the 1st defendant, the 1st 3rd defendant have any power or authority to suspend the plaintiff as the chairman of Kwara Executive Committee of the 1st defendant without observing the rules of fair hearing or the observance of the rules of natural Justice.
