Judgement

OG UNWUMIJU, J.S.C. (Delivering the Leading Judgment):This is an appeal against the final judgment of the Court of Appeal sitting at Benin City, Edo State Coram: Mojeed Adekunle Owoade. Ita G. Mbaba, Uchechukwu Onyemenam, Amina A. Wambai and Abubakar Sadiq Umar, (JJCA) affirming the final judgment of the trial tribunal, which dismissed the petition filed by the appellant.

The facts that led to this appeal are as follows: -

The appellant and the 2nd respondent were two of the .political parties who sponsored candidates in the Edo State Governorship Election heId on the 19th day of September 2020, while the 3rd and4th respondents as the 2nd respondents candidates participated in the said election. At the end of the Gubernatorial election, the 3rd and 4threspondents herein were declared the winners of the said election as Governor and Deputy Governor. respectively all 9th of October2020, the appellant filed a petition at the trial tribunal challenging the aforesaid return of the 3rd and 4t…
