JOSEPH OLUBUNMI KAYODE OYEWOLE, J.C.A. (Delivering the Leading Judgment): This is in respect of an appeal against the decision of the National/State Houses of Assembly Election Petition Tribunal holden at Owerri coram; Hon. Justice R. O. OLORUNFEMI (Chairman), Hon. Justice M. L. LAWAN (Member I) and Hon. Justice N. M. OBOT (Member II) delivered in Petition No EPT/OW/SEN/5/2020 on the 27th day of February, 2021.

The 1st Respondent conducted a Senatorial Bye Election to elect a Senator for the Imo North Senatorial District which election was held on the 5th December, 2020 across the said Imo North Senatorial District. The Appellant being a registered political party sponsored a candidate in the said election in respect of which a result was announced by the 1st Respondent on the 6th December, 2020 declaring the 2nd Respondent which sponsored the 3rd Respondent as candidate in the said election, as winner.
