MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): In suit No. M/237/2005 before the Lagos High Court, the Respondent by the Third Amended Statement of Claim dated and filed on the 6th July, 2017, claimed against the Appellant as follows: -

WHEREOF the claimant's claim against the defendant is for:-

a. A declaration that the claimant is entitled to the statutory right of occupancy in respect of the properly delimited on survey plan No. KESH/L/527 dated the 18th day of April, 1995 presently being called No. 23, Ipaye close, Surulere, Lagos State.

b. The total sum of N2,005,200.00 (Two Million Five Thousand and Two Hundred Naira) as specific and general damages.

c. Perpetual injunction restraining the Defendant, his agents, privies, servants and or assign from further acts to trespass on the claimant's father's land properly delineated on survey Plan No. KESH/L/527 dated the 18th day of April, 1995 presently being called No. 23, Ipaye close, Surelere, Lagos State."
