OSEJI JCA (Delivering the Lead Judgment): This appeal is against the ruling of the Federal High Court, Lagos Division, delivered by Musa Haruna Kurya J., on 26 February 2013, in charge No. FHC/L/145C/2012, wherein the appellant’s application for the charge brought against him to be struck out for lack of jurisdiction was refused.
On 30 April 2012, the appellant herein was arraigned before the Federal High Court, Lagos Division, on a four count charge which reads thus:

That you, Lucky Eyis Amiwero ‘M’ of plot 8, Reigneth Plaza, Ibafon, Apapa, Lagos, on or about, 1 March to 17 April 012 within Lagos and within the jurisdiction of the Federal High Court, without authority to act, signed and authorized the issuance of document to the President of the Federal Republic of Nigeria and you thereby committed an offence contrary to the proves section 107(3) of the Criminal Code Act Cap. C38 Laws of the Federation of Nigeria 2004 and punishable under the same section of the Act.
