JUDGMENT

1.0 Background

1.1 On 6 October 2012, the Petitioner got married to the Respondent under the Marriages Act, 1884-1985 (CAP. 127) at Dela Cathedral in Ho. They cohabited first at a rented apartment at Anagokodzi near the Foresight Hospital and later at Amenueve Ho near Power House. There had since been one child in the marriage - Godiva Xorlali Ampony. Seven years after the marriage, a greater part of which the Petitioner has been ordinarily resident outside the country, the Petitioner on 16 April 2019 per his lawful attorney Bright Kumah Dornya filed this petition through his lawyer averring that the marriage has broken down beyond reconciliation and that the Respondent by her behavior has caused him so much pain, anxiety, and distress that he cannot reasonably be expected to live any longer with the Respondent.
