Judgement

IGNATIUS IGWE AGUBE, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment of Honourable Justice B.A Nwankwo of the Anambra State High Court sitting in Ihiala, delivered on the 31st day of March, 2008.

Pursuant to the leave granted to the Applicant hereinafter referred to as 1st Respondent, on the 16th day of July, 2008, the 1st respondent on 28th of July, 2008 filed his substantive application for the enforcement of his fundamental rights: In the application, he sought the following reliefs.

(a) A declaration that the arrest and detention of the applicant along with his wife and son by the respondents from the 1st day of April, 2008 to the 3rd day of April, 2008 infringed his fundamental Right to personal liberty.

(b) A declaration that the continued threat and several attempts by the respondents to arrest the applicant violate his fundamental Right to personal Liberty.

(c) Damages of N10 Million

(d) Public Apology.
