Judgement

HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Anambra State, Onitsha Judicial Division, delivered by Hon. Justice V. N. Agbata on 26/07/10.

The Respondent as plaintiff instituted an action against the Appellant at the trial Court claiming via his Statement of Claim that the Respondent handed over title documents of four shops at the New Electronics Market Ogbaru to the Appellant to sell at N500,000.00 each on his behalf.

The Respondent claimed that the Appellant sold the said four shops and refused to hand over the proceeds in full, paying him the sum of N369,000.00 in total. Respondent sought to recover the balance of N1,631,000.00 and instituted the action seeking the following reliefs:

1. N1,631,000 (One Million, Six Hundred and Thirty-One Thousand Naira) being balance unpaid of the amount payable to the plaintiff from the sales of the four stores sold by the plaintiff.
