This is an appeal from concurrent findings of guilt by two courts presided over by learned judges and it is therefore necessary since we unanimously consider that the conclusions arrived at in these courts are erroneous in law, to set down fully the legal reasons which compel us to disagree with the judgments of these courts. It was for this reason that after hearing the arguments of counsel on 17 February 1986 we decided at once to give judgment allowing the appeal and adjourn to today to give well considered reasons for our decision.
The case commenced its unfortunate career to this court when the appellant, a private secretary employed by the State, was arraigned before the circuit court judge in Accra on 13 December 1984 on a charge of stealing ¢30,000, the property of a High Court judge, contrary to section 124 (1) of the Criminal Code, 1960 (Act 29).
